Please read these Terms of Service ("Terms") carefully before using the website located at blackbvt.com (the "Site") or purchasing any products from BLACK BVT LLC ("BLACKBVT," "we," "us," or "our"). By accessing or using our Site and placing an order, you agree to be bound by these Terms.

1. Age Requirement

This website contains adult content intended for persons 18 years of age or older. By accessing this Site, you confirm that you are at least 18 years of age. If you are under 18, you must leave this Site immediately. BLACK BVT reserves the right to refuse service to anyone who cannot verify their age or who misrepresents their age.

You also confirm that the purchase of adult products is legal in your jurisdiction. It is your responsibility to know and comply with the laws of your local jurisdiction.

2. Products and Made-to-Order Policy

All BLACK BVT products are made to order. Each item is individually cast upon receipt of your order. As a result:

  • Production times of 1–3 weeks apply before items ship
  • Minor variations in dimensions, color, and texture are inherent to the handcrafted process and are not considered defects
  • Custom colorway orders are unique and one-of-a-kind; exact color matching cannot be guaranteed
  • Orders cannot be cancelled once production has begun

All product descriptions, dimensions, and images on this Site are provided for informational purposes. We make reasonable efforts to accurately represent our products but cannot guarantee exact dimensions or color representation due to device display differences.

3. Pricing and Payment

All prices on the Site are listed in US Dollars (USD) and are subject to change without notice. The price charged will be the price in effect at the time of order placement.

Payment is processed securely through our third-party payment processor. BLACK BVT does not store payment card information on our servers. By providing payment information, you represent that you are authorized to use the payment method provided.

Your payment statement will reflect a neutral merchant description for privacy.

4. Shipping

All orders ship in discreet, plain outer packaging with no exterior branding indicating the nature of the contents. You are responsible for providing an accurate shipping address at the time of order.

BLACK BVT is not responsible for orders lost due to incorrect addresses, refused delivery, or theft after confirmed delivery. International customers are responsible for all customs duties, taxes, and import fees applicable in their jurisdiction.

Free shipping is offered on domestic US orders over $100. Standard shipping rates apply to orders below this threshold.

5. Returns and Refunds

Due to the intimate and made-to-order nature of our products:

  • We do not accept returns or exchanges on used products under any circumstances
  • Unused products may be returned within 7 days of delivery in original, unopened condition for a refund of the product price (minus shipping)
  • Defective or damaged items will be replaced or refunded — contact us within 7 days of delivery with photographic evidence
  • Custom colorway orders are final sale due to their one-of-a-kind nature

6. Intellectual Property

All content on this Site — including but not limited to text, graphics, product designs, photographs, the BLACK BVT name and logo, and all underlying sculpture designs — is the exclusive intellectual property of BLACK BVT LLC or its licensors. All rights reserved.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this Site without the express written consent of BLACK BVT LLC. This includes our product designs — all sculptures are 100% original and protected under applicable copyright law.

7. Prohibited Uses

You agree not to use this Site or any BLACK BVT products:

  • For any unlawful purpose or in violation of any applicable laws
  • To impersonate BLACK BVT LLC or misrepresent an affiliation with BLACK BVT
  • To purchase on behalf of persons under 18 years of age
  • To engage in unauthorized scraping, data harvesting, or automated access
  • To transmit unsolicited commercial communications (spam)

8. Disclaimer of Warranties

This Site and all products are provided "as is" without warranties of any kind, either express or implied, except as required by applicable law. To the maximum extent permitted by law, BLACK BVT disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

BLACK BVT makes no warranty that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BLACK BVT LLC and its members, officers, employees, agents, and successors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, even if BLACK BVT has been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you for the order giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BLACK BVT LLC and its members, officers, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your use of the Site or our products.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which BLACK BVT LLC is registered, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
